By accessing or using any website, landing page, CRM, enrollment platform, quoting system, communication channel, or digital service operated by Bosch Insurance Group (“Bosch Insurance Group,” “BIG,” “we,” “us,” or “our”), you agree to these Terms of Use (“Terms”). If you do not agree, please discontinue use immediately.

1. SMS Messaging Terms & Compliance

Bosch Insurance Group SMS Program

By providing your mobile number and opting in, you agree to receive text messages from Bosch Insurance Group related to appointments, quote follow-up, enrollment updates, policy servicing, customer support, occasional marketing, and other insurance-related communications you have requested or agreed to receive.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchase. To rejoin after opting out, opt in again through the original form or consent method.

By opting in to receive SMS messages from Bosch Insurance Group, you represent that you are the authorized user of the mobile number provided and that you consent to receive recurring automated or non-automated text messages from Bosch Insurance Group at that number, as applicable.

Opt-Out Instructions

You may opt out of SMS communications at any time by replying STOP to any message from us. After we receive your request, we will send a confirmation message and you will no longer receive text messages from that messaging program unless you opt in again.

Rejoining Instructions

If you previously opted out and want to rejoin, you may do so by opting in again through the same method you originally used, including a website form, quote request form, appointment request form, intake form, or other documented consent process made available by Bosch Insurance Group.

Mobile Data Protection Statement

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Text messaging originator opt-in data and consent will not be shared with any third parties except aggregators and providers of the Text Message services necessary to deliver the messages you have requested or consented to receive.

Compliance Statement

Bosch Insurance Group strives to comply with applicable federal and state laws, regulations, and wireless industry standards governing SMS communications, including applicable provisions of the Telephone Consumer Protection Act (TCPA) and CTIA messaging principles and best practices.

We only send SMS messages in accordance with applicable law, consumer consent requirements, and wireless industry standards. Not all mobile devices, carriers, or jurisdictions are supported, and message delivery is subject to effective transmission by your wireless carrier. We reserve the right to modify or discontinue our SMS program or related terms at any time, subject to applicable law.

2. Broker / Non-Carrier Status

Bosch Insurance Group is an independent insurance agency. We are not an insurance company or insurance carrier, and we do not underwrite insurance policies, administer claims, or guarantee coverage, benefits, eligibility, premiums, or outcomes. All insurance products are subject to carrier underwriting, policy terms, conditions, exclusions, and applicable law.

3. No Guarantee of Results

We do not guarantee:

• approval for coverage

• premium rates

• benefits or provider access

• subsidy eligibility

• tax treatment or tax outcomes

• continued plan availability

Any quote, estimate, benefit summary, or recommendation is informational only unless and until confirmed by the applicable carrier, government agency, or plan administrator.

4. Marketplace / EDE Disclaimer

If you use our services in connection with the Health Insurance Marketplace, Healthcare.gov, or any Enhanced Direct Enrollment (“EDE”) platform, including but not limited to HealthSherpa or similar systems, you acknowledge that:

• your information may be transmitted to government systems, carriers, or approved enrollment systems as needed to process your request

• eligibility determinations, subsidy decisions, and enrollment outcomes are made by CMS, the Marketplace, or the applicable carrier, not Bosch Insurance Group

• separate terms, privacy notices, and security practices may apply to those systems

5. Permitted Use

The content and services provided through our websites and digital platforms are intended for lawful, personal, informational, and insurance-related use only. You may not:

• copy, reproduce, republish, upload, post, transmit, or distribute our content without permission

• reverse engineer, interfere with, or attempt unauthorized access to our systems

• use our websites, forms, or communications channels for unlawful, misleading, fraudulent, or abusive purposes

6. Electronic Communications

By using our websites, forms, portals, email, phone, or SMS channels, you consent to receive communications from us electronically, including notices, disclosures, reminders, and service communications, to the extent permitted by law and subject to your communication preferences.

7. No Medical, Legal, or Tax Advice

Bosch Insurance Group does not provide medical, legal, or tax advice. Any information we provide is for general informational and insurance-related purposes only and should not be relied upon as medical, legal, tax, or financial advice. 8. Intellectual Property

All content on our websites and digital platforms, including text, graphics, logos, branding, downloads, forms, and other materials, is owned by or licensed to Bosch Insurance Group and is protected by applicable intellectual property laws. No license is granted except for your limited personal, non-commercial use in connection with evaluating or receiving our services.

9. Disclaimer of Warranties

All services, websites, forms, platforms, and content are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Bosch Insurance Group shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

• coverage gaps

• claim denials

• subsidy or eligibility determinations

• tax consequences

• employer compliance failures

• missed deadlines caused by incomplete or inaccurate information supplied by others

• system outages, carrier delays, or platform failures

• delayed or undelivered email or text messages

11. Documentation Reliance Clause

Bosch Insurance Group relies on information supplied by clients, applicants, employers, government systems, carriers, and service providers. You acknowledge that we are not responsible for errors, omissions, delays, or adverse outcomes resulting from incomplete, inaccurate, outdated, or misleading information provided by you or others acting on your behalf.

12. Indemnification

You agree to defend, indemnify, and hold harmless Bosch Insurance Group and its owners, officers, employees, agents, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your use of our websites or services

• your breach of these Terms

• your violation of any law or third-party right

• inaccurate or incomplete information you provide

• employer plan administration or compliance failures not caused by Bosch Insurance Group

13. Social Media and Public Communications

If you interact with us through social media or other public platforms, you agree not to post or transmit confidential, personal, medical, or protected health information through those channels. We reserve the right to remove content, restrict access, or block users who post unlawful, misleading, abusive, offensive, or inappropriate material.

14. Eligibility

15. Termination

We reserve the right to suspend, restrict, or terminate access to our websites, forms, messaging programs, or other services at any time, without notice, if we believe you have violated these Terms, provided false information, engaged in unlawful conduct, or misused our systems.

16. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, our websites, communications, or services shall be resolved through binding arbitration, except where prohibited by law. Arbitration shall take place in the State of Michigan and shall be governed by Michigan law, without regard to conflict of law principles.

17. Class Action Waiver

To the fullest extent permitted by law, all disputes must be brought solely on an individual basis and not as part of any class, consolidated, representative, or collective action.

18. General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Bosch Insurance Group regarding your use of our websites, communications, and services, except as supplemented by other written agreements or disclosures required by law.

19. Changes to These Terms

We may update these Terms from time to time. Any revised version will be posted on our website with a new effective date. Your continued use of our websites, services, or communication channels after changes are posted constitutes acceptance of the revised Terms.
